Right of withdrawal
Pursuant to Articles 52 et seq. of the Consumer Code (Legislative Decree 206/2005), the Consumer (defined exclusively as a natural person who makes a purchase outside of their business and/or professional activity) has the right to withdraw from the contract without providing any reason:
- for purchases made on www.shopgaravinihome.it, within and no later than 14 calendar days from receipt of the products, and only if the original packaging has been retained;
- for purchases made on marketplaces, within and no later than 14 calendar days from actual receipt, provided that the marketplace’s conditions are not more favourable.
Pursuant to Article 59, letter c) of the Consumer Code, the right of withdrawal is excluded in the case where the goods sold have been made “to measure” or “customised” based on the individual and specific choices of the end customer.
Any product made in a size and/or finish and/or upholstery not present as a “ready stock product” is to be considered a customised product, as it is ordered and produced specifically for the requesting customer based on their free and personal choice.
How to exercise the right of withdrawal
The right of withdrawal will be considered correctly exercised if the Consumer has sent the notification of exercise of this right within the above timeframes, by means of an explicit declaration, which may consist, for example, in:
- completion of the form provided on the customer support hub page, followed by our communication confirming receipt and/or opening of the RMA (Returned Merchandise Authorization) procedure;
- completion and submission of the specially prepared downloadable model;
- a free-form declaration, sent by letter, registered letter with or without return receipt, email or PEC, containing the following correct and complete information: full details of the buyer (name, surname and address); their intention to exercise the right of withdrawal; the order details (number) and/or identification of the purchased item (other possible alphanumeric codes) for which the right is being exercised.

Packaging and return shipment
The Consumer is required to:
- return the goods complete with all parts, accessories, manuals and anything else received;
- ensure that the goods are correctly placed in their original packaging — if this is not available, the return cannot be processed; if damaged, the value of the goods and the corresponding refund will be reduced accordingly.
Pursuant to Article 57, paragraph 1, of Legislative Decree 206/2005, the Consumer is also responsible for shipping the goods at their own expense within and no later than 14 days from the notification of exercise of the right of withdrawal, to the address indicated below.
To avoid any inconvenience, please:
- indicate as sender the name of the person who made the purchase
- include inside the shipment a copy of the purchase order received or a copy of the declaration of exercise of the right of withdrawal
Without this information, it will be impossible for us to link the received product to the Consumer entitled to a refund, and consequently to proceed accordingly.
Furthermore, if the Consumer arranges the return shipment independently, we recommend obtaining appropriate insurance cover, as any damage will not be attributable to us for any reason.

Refund amount and processing
Article 56 of Legislative Decree 206/2005 establishes that the refund must be processed within 14 days of the notification of exercise of the right of withdrawal. The same article also provides that, in the case of goods sales, the refund may be withheld until the goods are actually received, or until the Consumer has demonstrated that the goods have been effectively returned to the owner for inspection — a necessary and essential step for the subsequent refund procedure.
Consumer’s liability for damage to products
Legislative Decree 206/2005 establishes that:
- pursuant to Article 57, paragraph 1: it is the Consumer’s obligation and responsibility to ship the goods;
- pursuant to Article 63, paragraph 1: “the risk of loss or damage to the goods, for reasons not attributable to the seller/owner, passes to the Consumer only at the moment when the Consumer, or a third party designated by the Consumer and different from the carrier, physically takes possession of the goods;”
- pursuant to Article 57, paragraph 2: “The Consumer is solely liable for any diminution in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods. The Consumer is in no case liable for the diminution in value of the goods if the Trader has failed to inform the Consumer of their right of withdrawal pursuant to Article 49(1)(h).”
This notice is provided throughout the entire purchase procedure, and a link is present at the bottom of every page. We therefore consider our disclosure obligation to be adequately fulfilled.
