Suspension or deletion of an account due to causes attributable to the User does not release the User from the obligation to pay any applicable fees or prices.

Although Products on shopgaravinihome.it are presented with the highest degree of technical accuracy possible, their visual representation on shopgaravinihome.it — through any means (including, as applicable, graphic materials, images, colours, sounds) — is to be understood as a general reference only and does not imply any warranty regarding the characteristics of the purchased Product. Each step, from product selection through to order submission, forms an integral and necessary part of the purchase procedure, which consists of the following steps:
- Users will select and choose the desired Product to add it to their purchase selection, specifying, where possible, the quantity and any technical and stylistic characteristics/variants.
- Users may modify their selection by adding or removing items from the cart and, where applicable, may provide specific instructions (e.g. “send with a gift receipt”).
- To access the checkout area, Users simply need to click the relevant button.
- Within the checkout area, Users will be asked, step by step, to provide their contact details, including billing address and, where different, shipping address.
- During the purchase procedure, Users may at any time modify, correct or replace the information provided and add a gift card, affiliate code or discount code (e.g. in the form of an alphanumeric Voucher), and may also abandon the purchase procedure entirely without consequence.

Any costs or fees arising from a failed or declined payment shall be borne by the User.

Ownership of the ordered Products will transfer to the User only upon payment of the final instalment.
Artisanal production of your order on shopgaravinihome.it
How long will it take for my order to be processed?
Order dispatch times depend on the type and availability of the Products ordered. Most of our Products are available as READY STOCK, where specified when adding the item to the cart. Others are put into production specifically following the order (e.g. customisations and/or other variations), and consequently delivery times may vary depending on raw material availability and external factors beyond our control.
The indicative timeframe for READY STOCK is 7–15 business days. The average timeframe for CUSTOM PRODUCTION of one of our items is a minimum of 4 to a maximum of 8 weeks. Delivery times are primarily indicative and are therefore not binding. No compensation for direct or indirect damages may be claimed on grounds of non-delivery or delayed delivery.
Delivery of products purchased on shopgaravinihome.it
shopgaravinihome.it offers the following delivery types:
- Floor delivery with assembly, known as “white glove delivery”
- Collection from our premises
Deliveries will be made to the address specified by the User during the purchase procedure and in the manner indicated in the order summary.
Regardless of the shipping option selected, it is the User’s responsibility to ensure that the purchased product can physically enter their home or intended place of use, that there are no access or movement difficulties for the assembly team, no obstructed passageways, narrow spaces or other impediments that would prevent the product from being brought in correctly.
Upon delivery, Users must check the contents of the parcel and immediately report any anomalies to the contact details provided in this document or as described on the delivery note. Users may refuse to accept the parcel if it is visibly damaged.
Delivery may only take place in the countries and/or territories specified in the relevant section of shopgaravinihome.it. Estimated delivery times are indicated on shopgaravinihome.it or will be clearly stated during the purchase procedure at checkout.
In the event of failed delivery
The Data Controller, Garavini S.r.l., accepts no liability whatsoever for delivery errors arising from inaccuracies and/or omissions made by the User when completing their purchase order, nor for any damages or delays occurring after handover to the carrier, where the carrier has been appointed by the User.
In all cases where goods are not delivered or collected at the established time or within the set deadline (where one has been predetermined), the said goods will be returned to the Data Controller Garavini S.r.l. or to a physical location of the Data Controller’s choosing, who will in either case contact the User to schedule a second delivery attempt or to agree on further arrangements.
Unless otherwise specified, any costs arising from delivery attempts made after the first shall be borne exclusively by the User.
User rights
Information on the right of withdrawal
Unless an exception applies (see product customisation), the User may be entitled to withdraw from the contract within the timeframe specified below — established as 14 days from delivery — for any reason and without justification. The User can find further information on the right of withdrawal in the dedicated section.
Pursuant to Article 59, letter c) of the Consumer Code, the right of withdrawal is excluded where the goods sold have been made “to measure” or “customised” based on the customer’s choices. Any product made in a size, finish or upholstery not available as ready stock on the original product page will be considered a customised product (chromatic variants), as it is made specifically for the Customer based on their own free and personal choice.
Please note that in order to exercise the right of withdrawal, the User must have retained the original packaging in which the product was delivered, in its intact condition. Otherwise, the return will not be possible.
Who is entitled to the right of withdrawal on shopgaravinihome.it
Where none of the exceptions listed below applies, Users acting as European Consumers are entitled by law to withdraw from all contracts concluded online (distance contracts), within the timeframes indicated below and without providing any reason. Users who do not meet these requirements are not entitled to the rights described in this section.
How to exercise the right of withdrawal on shopgaravinihome.it
To exercise the right of withdrawal, the User must send the Data Controller an unequivocal and official communication stating their intention to withdraw from the contract. For this purpose, the User may use the standard withdrawal form (link), also available in the dedicated section. The User is however free to express their intention to withdraw in any other form permitted by law. In order to strictly comply with the withdrawal deadline, the User must send the relevant declaration before the deadline expires.
When does the withdrawal period expire?
- The withdrawal period expires 14 days from the day on which the User or a third party designated by the User — other than the carrier — receives the goods ordered.
- In the case of purchase of multiple goods delivered separately, or purchase of a single good comprising multiple lots or pieces delivered separately, the withdrawal period expires 14 days from the day on which the User or a third party designated by the User — other than the carrier — receives the last of the goods, lots or pieces forming the order.
Effects of withdrawal
The Data Controller, Garavini S.r.l., will reimburse all payments received — including, where applicable, delivery costs — to Users who have correctly exercised the right of withdrawal. The refund will be issued by bank transfer. The User shall not bear any costs as a consequence of the withdrawal.
…on contracts for the purchase of physical goods
Unless the Data Controller has offered to collect the goods, the User is required to return them to the Data Controller or to other companies authorised by the Data Controller to receive them, without undue delay and in any case within 14 days from the day on which the User communicated their intention to withdraw from the contract.
The deadline is met if the goods are handed over to the carrier or other authorised company before the expiry of the 14-day period specified above. The refund may be withheld until receipt of the goods or until the Data Controller has been able to verify the integrity of the returned products, which must be in the same condition — both aesthetically and functionally — as when they were dispatched by the Data Controller and therefore as when they were delivered to the User’s address.
The User shall be liable for any diminution in the value of the goods attributable to handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Return shipping costs are borne by the User.
Warranties on shopgaravinihome.it
Product conformity warranty
OUR WARRANTY
The warranty is governed in accordance with the provisions of Legislative Decree no. 24 of 2 February 2002 implementing EU Directive 1999/44 and complies with Article 1519 septies of the Italian Civil Code. This warranty expressly recognises the consumer protection rights established under the legislation on the sale of consumer goods. The Consumer may fully enforce such rights against the seller under the conditions and within the timeframes provided by the aforementioned legislation and this legal warranty.
The goods are warranted by the Data Controller for a period of 2 years from the date of purchase. In all cases, to invoke the warranty, the User must formally, in detail and in writing, report the lack of conformity to the seller within a maximum of 2 months from the date of discovery, failing which the warranty will lapse. This warranty shall be considered void in all cases of improper use of the goods. In particular, the warranty does not cover any indentations of padded surfaces of less than 20 mm, as such values are considered physiological for the settling of ecological padding under the weight of the human body (tolerances and measurements in accordance with UNI EN 10707 and UNI EN 1334 standards). This warranty also does not cover any non-conformities resulting from negligence and/or carelessness in use, such as, for example, failure to observe the correct use and standard recommended maintenance instructions.
REGARDING PRODUCT IMAGES AND TECHNICAL DATA SHEETS
Product images are to be considered purely indicative. The dimensions stated in the technical section are approximate and subject to variation within a general tolerance of +/- 2%. The company reserves the right to make technical and production modifications to this model without prior notice.
MANUAL TILTING BACKREST MECHANISM AND FOOTREST RECLINER MECHANISM
All seating elements sold on shopgaravinihome.it carry a legal warranty on mechanisms of 2 years for non-conformities directly attributable to manufacturing defects.
PLEASE NOTE THAT ALL WARRANTY INFORMATION FOR INDIVIDUAL ITEMS SOLD BY THE DATA CONTROLLER WILL BE INCLUDED IN THE DOWNLOADABLE PRODUCT DATA SHEET AVAILABLE WHILE BROWSING SHOPGARAVINIHOME.IT.
In accordance with the legal information above, applicable law provides that the warranty on a purchased good lasts for two years. With regard to upholstery, the warranty does not cover the formation of pilling or shrinkage caused by cleaning methods not recommended by the Data Controller.
For the warranty to remain valid, for all seating elements and textile accessories produced and sold by the Data Controller, the Customer is required to retain, in digital and/or paper format, the order document sent at the time of purchase confirmation.
REGARDING REPAIRS AND REPLACEMENT PARTS NOT COVERED BY WARRANTY
If the required repair is not covered by the warranty, the Customer may nonetheless request it subject to a cost estimate. Transport costs for bringing the product to our premises and returning it to the Customer — whether for replacement, warranty repair or non-warranty repair — shall be borne entirely by the Customer. Excluded from the warranty are all defects that are the direct or indirect result of negligence or carelessness in use (e.g. failure to observe the instructions for use and maintenance, or transport damage), as well as all cases where the non-conformity cannot be attributed to a manufacturing defect and/or product non-conformity.
Where Users act as European Consumers, the legal conformity warranty for goods applies to items available on shopgaravinihome.it in accordance with the laws of the country in which they habitually reside. The national laws of that country may grant such Users broader rights. Consumers not acting as European Consumers may be entitled to conformity warranty rights under the legislation of the country in which they habitually reside.
Limitation of liability and indemnification
Australian Users — Limitation of liability
Nothing in these Terms excludes, limits or modifies any guarantee, condition, warranty, right or remedy that the User may have under the Competition and Consumer Act 2010 (Cth) or similar state and territory legislation that constitutes a right that cannot in any way be excluded, limited or modified (non-excludable right). To the maximum extent permitted by law, our liability to the User, including liability for breach of a non-excludable right and all other liability not otherwise excluded under these Terms and Conditions, is limited, at the Data Controller’s discretion, to re-supply of the services or payment of the cost of having the services re-supplied.
USA Users — Disclaimer of warranties
The Data Controller provides shopgaravinihome.it “as is” and “as available”. By using the Service, the User assumes all risk of any prejudice that may arise from the connection. The Data Controller expressly disclaims all conditions, representations and warranties of any kind — whether express, implied, statutory or otherwise, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose or non-infringement. No advice or information, whether oral or written, obtained by the User from the Data Controller or through the Service, shall create any warranty not expressly stated herein.
Without limiting the foregoing, the Data Controller and its subsidiaries, affiliates, officers, agents, co-branders, partners, suppliers and employees do not warrant that the content is accurate, reliable or correct; that the Service will be available on an uninterrupted, secure basis at any particular time or location; that any defects or errors will be corrected; or that the Service is free of viruses or other harmful components. Any content downloaded or otherwise obtained through use of the Service is downloaded at the User’s own risk, and the User is solely responsible for any damage to their computer system or mobile device or loss of data resulting therefrom or from the User’s use of the Service.
The Data Controller does not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by third parties through the Service or any hyperlinked website or service, and does not participate in or in any way monitor any transaction between Users and third-party providers of products or services.
The Service may become inaccessible or may not function properly with the User’s browser, device and/or operating system. The Data Controller cannot be held liable for any damage, whether perceived or actual, arising from the content, operation or use of the Service. Federal laws, some states and other jurisdictions do not allow the exclusion and limitation of certain implied warranties. The above exclusions may not apply to Users. This Agreement gives Users specific legal rights and Users may have other rights that vary from state to state. The limitations and exclusions set out in this Agreement apply to the extent permitted by law.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall the Data Controller and its subsidiaries, affiliates, officers, agents, co-branders, partners, suppliers and employees be liable for:
- any indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Service; and
- any damage, loss or injury resulting from hacking, tampering or other unauthorised access to or use of the Service or the User’s account or the information contained therein;
- any errors, mistakes or inaccuracies in content;
- personal injury or property damage, of any nature whatsoever, resulting from the User’s access to or use of the Service;
- any unauthorised access to or use of the Data Controller’s secure servers and/or any personal information stored therein;
- any interruption or cessation of transmission to or from the Service;
- any bugs, viruses, trojan horses or the like that may be transmitted to or through the Service;
- any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available through the Service; and/or
- the defamatory, offensive or illegal conduct of any User or third party. In no event shall the Data Controller and its subsidiaries, affiliates, officers, agents, co-branders, partners, suppliers and employees be liable for any claims, proceedings, liabilities, obligations, damages, losses or costs in an amount exceeding the amount paid by the User to the Data Controller in the preceding 12 months, or the period of duration of this Agreement between the Data Controller and the User, whichever is shorter.
This limitation of liability section applies to the fullest extent permitted by law in the applicable jurisdiction, regardless of whether the alleged liability is based on contract, tort, negligence, strict liability or any other basis, even if the Data Controller had been advised of the possibility of such damage. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore, the above limitations or exclusions may not apply to the User. These Terms give the User specific legal rights and the User may have other rights that vary from jurisdiction to jurisdiction. The disclaimers, exclusions and limitations of liability under these Terms do not apply to the extent prohibited by applicable law.
Indemnification
The User agrees to defend, indemnify and hold harmless the Data Controller and its subsidiaries, affiliates, officers, agents, co-branders, partners, suppliers and employees from and against any and all claims or demands, damages, obligations, losses, liabilities, costs or debts and expenses, including, without limitation, legal fees and expenses, arising from:
- the User’s use of or access to the Service, including any data or content transmitted or received by the User;
- the User’s breach of these Terms, including, without limitation, any breach of any of the User’s representations and warranties set out in these Terms;
- the User’s violation of any third-party rights, including, without limitation, any privacy or intellectual property rights;
- the User’s violation of any applicable law, rule or regulation;
- any content submitted from the User’s account, including, without limitation, misleading, false or inaccurate information, and including cases where access is made by third parties using the User’s personal username and password or other security measures, if applicable;
- the User’s wilful misconduct; or
- the User’s or their affiliates’, officers’, agents’, co-branders’, partners’, suppliers’ or employees’ statutory violation, to the extent permitted by applicable law.
Common provisions
No implied waiver
The Data Controller’s failure to exercise any legal right or claim arising under these Terms shall not constitute a waiver thereof. No waiver shall be considered final with respect to a specific right or any other right.
Service interruption
To ensure the best possible level of service, the Data Controller reserves the right to interrupt the Service for maintenance purposes, system updates or any other changes, providing appropriate notice to Users. To the extent permitted by law, the Data Controller reserves the right to suspend or fully terminate the Service. In the event of termination, the Data Controller will endeavour to allow Users to extract their Personal Data and information in accordance with the law. Furthermore, the Service may be unavailable due to circumstances beyond the Data Controller’s reasonable control, such as force majeure events (e.g. strikes, infrastructure failures, blackouts, etc.).
Resale of the Service
Users are not authorised to reproduce, duplicate, copy, sell, resell or exploit shopgaravinihome.it or the Service in whole or in part, without the Data Controller’s prior written consent, expressed directly or through a legitimate resale programme.
Privacy policy
Information on the processing of Personal Data is contained in the privacy policy of shopgaravinihome.it.
Intellectual property
Without prejudice to any more specific provision contained in these Terms, intellectual and industrial property rights — such as copyrights, trademarks, patents and designs — relating to shopgaravinihome.it are held exclusively by the Data Controller or its licensors and are protected under applicable legislation and international intellectual property treaties. All trademarks — whether word or figurative — and all other distinctive signs, trade names, service marks, illustrations, images or logos appearing in connection with shopgaravinihome.it are and remain the exclusive property of the Data Controller or its licensors and are fully protected under applicable legislation and international intellectual property treaties.
Changes to these Terms
The Data Controller reserves the right to modify these Terms at any time. In such cases, the Data Controller will give appropriate notice of the changes to Users. Changes will only affect the relationship with the User going forward. Continued use of the Service implies the User’s acceptance of the updated Terms. If the User does not wish to accept the changes, they must stop using the Service. Failure to accept the updated Terms may entitle either party to withdraw from the Agreement. The previously applicable version continues to govern the relationship until the User accepts the updated version. Such version may be requested from the Data Controller. Where required by applicable law, the Data Controller will specify the date by which the changes to the Terms will take effect.
Assignment of contract
The Data Controller reserves the right to transfer, assign, dispose of by novation or subcontract any or all rights and obligations under these Terms, having due regard for the User’s legitimate interests. The provisions regarding modifications to these Terms apply accordingly. The User is not authorised to assign or transfer their rights and obligations under these Terms without the Data Controller’s written consent.

Severability
Should any provision of these Terms be or become null or ineffective under applicable law, the nullity or ineffectiveness of such provision shall not render the remaining provisions ineffective, which shall therefore remain valid and effective.
For European Users
Should any provision of these Terms be or become null, invalid or ineffective, the parties will endeavour to find, by mutual agreement, a valid and effective replacement for the null, invalid or ineffective provision. Failing such agreement, if permitted or provided for by applicable law, the null, invalid or ineffective provision shall be replaced by the applicable statutory rules. Without prejudice to the foregoing, the nullity, invalidity or ineffectiveness of a specific provision of these Terms shall not render the entire Agreement null, unless the null, invalid or ineffective provisions are essential or of such importance that the parties would not have entered into the contract had they known the provision would be invalid, or in all cases where the remaining provisions could impose an excessive and unacceptable burden on either party.
USA Users
Any invalid or ineffective provision shall be interpreted and adapted to the extent necessary to make it valid, effective and consistent with its original purpose. These Terms constitute the entire agreement between the User and the Data Controller with respect to the subject matter hereof and supersede all other communications, including any prior agreements between the parties, with respect to the subject matter hereof. These Terms shall be enforced to the fullest extent permitted by law.
Governing law
These Terms are governed by the law of the place where the Data Controller is established, as indicated in the relevant section of this document, irrespective of conflict of law rules.
Exception for European Consumers
Notwithstanding the foregoing, where the User acts as a European Consumer and has their habitual residence in a country whose law provides a higher level of consumer protection, that higher level of protection shall prevail.
Jurisdiction
Exclusive jurisdiction to hear any dispute arising from or in connection with these Terms lies with the court of the place where the Data Controller is established, as indicated in the relevant section of this document.
Exception for European Consumers
The foregoing does not apply to Users acting as European Consumers or Consumers located in Switzerland, Norway or Iceland.
Dispute resolution
Amicable settlement of disputes
Users may report any disputes to the Data Controller, who will endeavour to resolve them amicably. Without prejudice to the User’s right to bring legal action, in the event of disputes concerning the use of shopgaravinihome.it or the Service, Users are invited to contact the Data Controller at the contact details provided in this document. The User may direct a complaint to the Data Controller’s email address indicated in this document, including a brief description and, where applicable, the details of the order, purchase or account concerned. The Data Controller will respond without undue delay and within 21 days of receipt.
Consumer dispute resolution platform
The European Commission has established an online platform for alternative dispute resolution that facilitates the out-of-court settlement of disputes relating to and arising from online sales and service contracts. Accordingly, any European Consumer has the full right to use this platform to resolve any dispute arising from contracts concluded online. The platform is available here.
